1 General Terms and Conditions
1. These Terms and Conditions set out the rules regarding:
withdrawal from the contract,
returns,
submitting and processing complaints,
and warranty claims.
2. These Terms and Conditions apply to Customers who are Consumers and – to the extent permitted by law – to business customers.
3. The Seller is “BIOMAK” Sylwester Kiełbowski and Karol Kiełbowski SP.J, with its registered office in Piastów.
4. These Terms and Conditions are available in: Polish, English and Russian.
5. In the event of discrepancies between language versions, the Polish version shall prevail.
2 Right to withdraw from the contract (returns)
1. The Consumer has the right to withdraw from a contract concluded at a distance or outside the business establishment within 14 days of receiving the goods, without giving any reason.
2. To withdraw from the contract, the Consumer must submit a return form:
in writing (by enclosing the completed form with the parcel)
electronically (by email to: biomak@biomak.pl)
3. The Seller shall immediately confirm receipt of the notice.
3 Exclusions from the right of withdrawal
The right to withdraw from the contract does not apply in the case of:
1. products made to the Customer’s individual order (e.g covers),
2. products modified according to the Customer’s specifications (e.g. upholstery colour other than white),
3. products which, after delivery, have been assembled (e.g. furniture) or used in a way that prevents their resale.
4 Return conditions
1. A return is possible if:
the product shows no signs of use,
it is complete,
it is in its original packaging (opened only for inspection).
2. The consumer bears the direct costs of returning the goods (transport costs), the costs of packaging, securing and posting the return.
3. It is recommended that proof of purchase be included with the return
5 Refunds
1. The Seller shall refund all payments received from the Consumer, including delivery costs to the client (up to the cost of the cheapest available option), within 14 days of the date of withdrawal from the contract (completion of the return form and return of the goods).
2. Refunds will be made using the same payment method used by the Customer, unless the Customer agrees to an alternative solution at no additional cost.

The Seller may withhold the refund until the goods have been received or proof of their return has been provided.
6 Seller’s liability (conformity of goods with the contract)
1. The seller is liable to the consumer for any lack of conformity of the goods with the contract for a period of 2 years from the delivery of the goods.
2. The goods are in conformity with the contract if:
they correspond to the description and functionality,
they are suitable for their normal use,
they are complete and in accordance with the offer.
3. It is presumed that any lack of conformity discovered during this period existed at the time of delivery, unless proven otherwise.
7 Consumer rights
1. In the event of a lack of conformity of the goods with the contract, the Consumer may demand:
the removal of the defect,
replacement with goods free from defects,
a price reduction,
withdrawal from the contract.
2. The Seller shall consider the complaint within 14 days of receiving the complaint form.
3. Failure to respond shall constitute acceptance of the complaint.
8 Complaints Procedure
1. A complaint may be lodged:
with the Seller,
or voluntarily under the manufacturer’s warranty.
2. The complaint should include:
a description of the defect,
the Customer’s details
3. It is recommended that proof of purchase be provided
4. The Customer is obliged to deliver the product to the Seller.
9 Warranty
1. The warranty is a voluntary provision by the manufacturer.
2. The terms of the warranty are set out in the warranty certificate.
3. The warranty does not exclude the Consumer’s statutory rights.
10 Transport damage

It is recommended that you inspect the parcel upon delivery.

In the event of damage, a damage report must be drawn up immediately upon receipt of the parcel.
11 Exclusions of liability
1. A complaint may be rejected in the event of:
normal wear and tear,
incorrect use,
mechanical damage caused by the user.
2. These provisions do not limit the Consumer’s statutory rights.
12 Uncollected products
1. If a product is not collected, the Seller will attempt to contact the Customer.
2. Further proceedings shall be conducted in accordance with the law.
13 Dispute resolution
1. The Consumer may seek mediation.
2. These Terms and Conditions do not limit the Consumer’s rights.
